Acceptance of Terms
Agreement to Terms
By accessing or using SpotsHunt's services, including our mobile application and website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our services.
Updates to Terms
We may modify these terms at any time. We will notify users of significant changes through the app or via email. Continued use of our services after changes constitutes acceptance of the new terms.
Eligibility
You must be at least 13 years old to use our services. If you are between 13 and 18, you must have parent or guardian permission. By using our services, you represent that you meet these age requirements.
Description of Services
Platform Overview
SpotsHunt is a location-based discovery platform that helps users find interesting places, complete challenges, and earn rewards. We connect explorers with local businesses through gamified experiences.
User Accounts
To use certain features, you must create an account with accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
Location Services
Our services rely on location data to function properly. By using location-based features, you consent to our collection and use of location information as described in our Privacy Policy.
Rewards and Experience Points (XP)
Users earn Experience Points (XP) by completing challenges and discovering spots. XP has no monetary value and cannot be exchanged for cash or transferred between accounts. XP is solely a gamification metric to track engagement. Rewards are provided by sponsor businesses, not by SpotShunt. SpotShunt acts as a platform facilitating connections between users and sponsors. Rewards are subject to availability, sponsor terms, and may have expiration dates. We reserve the right to modify or discontinue the XP system at any time.
User Conduct & Responsibilities
Acceptable Use
You agree to use our services lawfully and respectfully. You will not engage in activities that harm other users, businesses, or our platform, including harassment, fraud, or spreading false information.
Content Guidelines
Any content you share (photos, reviews, comments) must be appropriate, accurate, and not infringe on others' rights. We reserve the right to remove content that violates our guidelines.
Safety Requirements
When visiting spots hunt, you must follow all applicable laws, respect private property, and prioritize safety. You are responsible for your actions and any consequences during exploration.
Account Security
You must keep your login credentials secure and notify us immediately of any unauthorized access to your account. Do not share your account with others or create multiple accounts.
Business Partnership Terms
Partner Registration
Businesses can register to become SpotsHunt partners by providing accurate business information and agreeing to our partner terms. We reserve the right to approve or reject partnership applications.
Payment Terms & Processing
Business partners agree to pay subscription fees according to their chosen plan (Monthly or Yearly). All payments are processed securely through Razorpay, our authorized payment gateway partner. Subscription fees are charged in advance at the start of each billing cycle. SpotShunt does not store complete card details or banking information—all payment data is securely handled by Razorpay in compliance with industry standards. Failure to pay subscription fees may result in service suspension or termination.
Refunds and Cancellations
Refunds are provided only if the subscribed service is not delivered as promised. Refund requests must be submitted within 7 days of payment. Approved refunds are processed via Razorpay within 7-10 business days. Subscription cancellations stop future billing but do not refund the current billing period. No refunds are provided for partial usage of subscription services. For complete refund and cancellation terms, please refer to our Refund & Cancellation Policy.
Challenge Creation
Partners can create challenges and offers for their locations. All challenges must comply with our guidelines and local laws. We reserve the right to review and remove inappropriate challenges.
Data and Analytics
Partners receive access to analytics about user visits and engagement. This data is provided for business purposes only and may not be shared with third parties without consent.
Platform Role & Nature of Service
Platform Facilitator
SpotShunt operates as a digital platform that connects explorers with sponsor businesses. We facilitate discovery experiences and reward programs but do not directly provide or guarantee rewards. Sponsors are solely responsible for their offers, rewards, and fulfillment obligations.
No Monetary Transactions with Users
SpotShunt is free for end users. We do not collect payments from users for discovering spots, completing challenges, or earning XP. Our revenue model is based exclusively on business sponsor subscriptions processed through Razorpay. Users never make payments to SpotShunt.
Digital Services Only
SpotShunt provides purely digital services including the mobile application, web platform, location-based discovery tools, and business dashboard. We do not sell, ship, or deliver any physical goods. All services are provided electronically.
No Gambling or Gaming
SpotShunt is not a gambling, gaming, or betting platform. XP cannot be wagered, traded for money, or withdrawn as cash. Our platform is designed for legitimate location-based discovery and business-customer engagement.
Intellectual Property
Our Rights
SpotsHunt and its content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our content without permission.
User Content License
You retain all ownership rights to content you create and share on our platform. By posting, uploading, or otherwise making content available, you grant SpotShunt a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your content in connection with operating, promoting, and improving our services. This license continues even after you stop using our services, except for content that you delete (subject to technical limitations and backup systems). You represent and warrant that you own or have the necessary rights to grant this license, and that your content does not violate any third-party rights or applicable laws.
Trademarks
The SpotsHunt name, logo, and other marks are our trademarks. You may not use our trademarks without our written permission.
DMCA Policy
We respect intellectual property rights and will respond to valid DMCA takedown notices. If you believe content infringes your rights, please contact us with details.
Disclaimers & Limitation of Liability
Service Availability
We provide our services 'as is' without warranties. We do not guarantee uninterrupted access and may experience downtime for maintenance or other reasons.
User Safety
While we strive to verify information about spots hunt, we cannot guarantee the safety or accuracy of all locations. Users explore at their own risk and must exercise caution.
Third-Party Content
Our platform may include content from users and business partners. We do not endorse or guarantee the accuracy of third-party content and are not liable for any issues arising from it.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (1) SpotShunt shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, revenue, business opportunities, data, business interruption, or reputational harm. (2) Our total liability for any claims shall not exceed the amount you paid to SpotShunt in the 12 months preceding the claim, or ₹1,000 if no payments were made. (3) Some jurisdictions do not allow exclusion of certain warranties or limitation of liability for incidental damages, so some limitations may not apply to you.
Indemnification
Your Indemnification Obligations
You agree to indemnify, defend, and hold harmless SpotShunt, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from: (a) Your use or misuse of our services, (b) Your violation of these Terms of Service, (c) Your violation of any rights of another party, including other users or business partners, (d) Your content or conduct on the platform, (e) Your breach of any applicable laws or regulations.
Defense and Settlement
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim. You will not settle any claim that affects SpotShunt without our prior written consent.
Additional Terms
Termination
We may suspend or terminate your account at any time for violation of these terms. You may also delete your account at any time through the app settings. Upon termination, your right to use the services will cease immediately.
Service Modifications and Availability
We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. This includes the right to change features, functionality, or availability, impose limits on certain features, restrict access to parts of the service, or perform maintenance that may temporarily interrupt service. We are not liable to you or any third party for any modification, suspension, or discontinuation of services. You agree that we have no obligation to maintain, support, or provide updates to the services.
Force Majeure
SpotShunt shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God (earthquakes, floods, fires, storms), war, terrorism, civil unrest, government actions or regulations, labor disputes, pandemics, epidemics, Internet or telecommunications failures, power outages, infrastructure failures, or any other events beyond our control. During such events, our obligations under these Terms shall be suspended for the duration of the force majeure circumstance.
Dispute Resolution
Before filing any legal action, you agree to first attempt to resolve any disputes informally by contacting us at support@spotshunt.com with a detailed description of the dispute. We will attempt to resolve the matter within 30 days. If we cannot reach an informal resolution, disputes shall be subject to the exclusive jurisdiction of the courts in Ranchi, Jharkhand, India. You agree to waive any right to participate in class action lawsuits or class-wide arbitration against SpotShunt.
Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of India. Any disputes, claims, or controversies arising out of or relating to these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Ranchi, Jharkhand, India. If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full effect.
Entire Agreement
These Terms of Service, together with our Privacy Policy, constitute the entire agreement between you and SpotsHunt regarding your use of our services. They supersede any prior agreements or understandings.
